We all have bucket lists — a list of things that we want to do, on that day this evaporates into nothingness. A will is one of the most important documents you’ll ever create in your lifetime. Your will can clearly state who will be guardian of your minor children, who will inherit your assets, when they will inherit your assets, and any conditions that must be met. Without a valid will, the court does not have your instructions to follow. The state’s decisions may or may not conform to your wishes, Failing to indicate who receives these, your tangible assets or of sentimental value in your will can cause friction among your loved ones and a loss of togetherness. Any assets held jointly with right of survivorship automatically pass to the joint owner. And assets with a beneficiary designation, such as IRAs, life insurance, and annuities, pass as stated on the beneficiary form.
What happens when your surviving spouse dies? What happens if your beneficiary form is outdated? Will your children receive their share at too early an age? Does your spouse have the financial skill to manage the family wealth?
For parents, making a will is the single most important thing you can do to make sure your child is cared for by the people you would choose if anything should happen to you. In your will you can designate a guardian to care for your children if you die before they become legal adults. And you can designate a property guardian or trustee to manage your money for your children until they reach adulthood.
I strongly recommend a professional estate-planning attorney to assist you in drafting your will along with a plan to modify it if need be. I tend to shy away from the do-it-yourself wills, the few dollars you save now can cost your loved ones thousands later.
Creating a will forces each of us to come face-to-face with our own mortality—and dealing with death is difficult. But it will be much more difficult for your loved ones if you don’t have a will. Let's get this done today, before you're gone.
